In a move that has left law-abiding Americans stunned, a federal judge has just ruled that a known MS-13 gang member and accused human trafficker should not be detained before trial. Despite serious allegations, including child trafficking and connections to violent gang activity, the judge ruled against pretrial detention — sparking outrage and prompting a swift appeal from the Department of Justice.
Barbara Holmes, a U.S. magistrate judge in Tennessee, issued the controversial ruling on Sunday, determining that Kilmar Abrego Garcia — a self-admitted member of the notorious MS-13 and previously arrested for spousal abuse — didn’t meet the legal threshold to be held behind bars as he awaits trial.
Incredibly, Holmes stated that the government failed to prove Abrego Garcia posed a flight risk, posed a threat to justice, or was involved in crimes with a minor victim as defined under current bail laws.
