Former FBI Director James Comey is making a bold legal move to challenge the appointment of President Donald Trump’s handpicked U.S. attorney, Lindsey Halligan. The controversial maneuver puts Trump’s strategy of appointing loyal prosecutors directly into the judicial spotlight.
According to Axios, Comey is officially disputing the legitimacy of Halligan’s appointment in federal court. His legal team filed paperwork taking aim at the authority of the U.S. Attorney for the Eastern District of Virginia — the office now prosecuting him.
“James Comey, by counsel, will file his motion to dismiss challenging the lawfulness of the appointment of the United States Attorney for the Eastern District of Virginia,” Comey’s attorneys wrote.
In that same filing, Comey’s team signaled their expectation that an “out-of-district judge” will oversee the matter, a move that could shape the trajectory of the entire case.
