Newly released congressional testimony is raising fresh questions about how investigators obtained phone records tied to Republican lawmakers during the sprawling federal investigation that eventually landed in Special Counsel Jack Smith’s office.
Brian Burnett, a retired special agent with the Justice Department’s Office of Inspector General, told House Judiciary Committee investigators that he helped serve subpoenas for telephone records without being told that at least one of the numbers was associated with a sitting member of Congress.
The House Judiciary Committee released Burnett’s testimony along with transcripts from five former prosecutors who worked for Smith. The testimony concerns Arctic Frost, the federal investigation into efforts to challenge the results of the 2020 presidential election that ultimately fed into Smith’s investigation of President Donald Trump.
