Just days after Arkansas Senator Tom Cotton demanded accountability, the Office of Special Counsel (OSC) has opened an official investigation into former Special Counsel Jack Smith for possible violations of the Hatch Act — a federal law designed to keep government employees from abusing their positions for political purposes.
According to The New York Times, the OSC is now reviewing whether Smith, who infamously led two major failed prosecutions against President Donald Trump, crossed legal lines in the process. The New York Post revealed it had obtained an internal email from Senior Counsel Charles Baldis at OSC confirming that the agency is examining the matter.
This development comes amid growing concern on Capitol Hill that Smith used his power inside the Department of Justice not to enforce the law—but to sway the outcome of the 2024 presidential election.
Sen. Cotton didn’t mince words. “I appreciate the Office of Special Counsel taking this seriously and launching an investigation into Jack Smith’s conduct. No one is above the law,” he stated. He then slammed Smith’s alleged political maneuvering, saying, “Jack Smith’s actions were clearly driven to hurt President Trump’s election, and Smith should be held fully accountable.”
