In a decisive move, The Heritage Foundation, a prominent conservative organization, has approached a federal court in Washington, D.C., seeking an urgent release of audio tapes from President Joe Biden’s discussion with special counsel Robert Hur. The request, driven by the White House’s recent claim of executive privilege, underscores a growing tension between governmental transparency and executive secrecy.

Filed on May 17, the emergency motion at the U.S. District Court for the District of Columbia aims to alter the existing timeline for three ongoing Freedom of Information Act (FOIA) lawsuits. These lawsuits demand the disclosure of approximately five hours’ worth of audio recordings from interviews conducted by Hur with the President, centering on a probe into mishandled classified documents.

The Heritage Foundation’s legal team contends that the urgency of these lawsuits has intensified following President Biden’s executive privilege claim over the tapes on May 16. They argue that the Department of Justice (DOJ) has overstated its need for preparation time in responding to these FOIA requests, asserting, “The Department’s asserted time constraints were misleading,” and “The Department did not need the time to prepare a position and declarations it twice told the Court it did. A formal assertion of Executive Privilege is an extraordinary undertaking.”
