U.S. District Judge Timothy Kelly has scheduled DOJ submissions defending the tape’s withholding until May 31, with further filings permitted through July 29. However, the emergency motion requests that these deadlines be advanced to May 27 and July 1, respectively.
The recordings are pivotal in the clash between House Republicans and Attorney General Merrick Garland, who has resisted a subpoena for the tapes, leading to potential contempt proceedings. House Republicans assert the necessity of the tapes to corroborate Hur’s observations that President Biden had lapses in recollection during their interviews. They suggest a biased approach in the justice system, contrasting Hur’s decision not to prosecute President Biden with the ongoing legal challenges facing former President Donald Trump over similar allegations of mishandling classified information.
In his extensive 388-page report, Hur noted that President Biden, presenting as “a sympathetic, well-meaning, elderly man with a poor memory,” likely retained and disclosed classified materials after his vice-presidential term under the Obama administration. Despite criticisms from Democrats and the White House about his remarks concerning the President’s cognitive abilities, Hur recommended no charges, attributing this decision to the President’s memory issues.
Democrats, conversely, accuse Republicans of seeking the tapes to weaken Biden’s image, portraying him as an incapable leader, thus undermining his potential re-election bid.
In March, Hur disclosed during his testimony to the House Judiciary Committee that White House officials attempted to moderate his report’s descriptions of Biden’s memory concerns.

Amidst these disputes, the White House remained silent on inquiries about their stance on the tapes. On May 16, President Biden exerted executive privilege over the recordings, with White House counsel Ed Siskel justifying this as necessary to protect the integrity of future investigations. Siskel accused House Republicans of intending to misuse the recordings for “partisan political purposes,” criticizing their demands as a manipulation for political advantage.
As the controversy escalates, both the House Oversight and Judiciary Committees have already voted to recommend holding Garland in contempt, a measure that must still pass the House floor. House Speaker Mike Johnson criticized the blocking efforts, suggesting that President Biden fears the public hearing the recordings. The unfolding legal and political drama continues to draw significant attention, promising further developments in this high-stakes battle over presidential accountability and transparency.

Why NOT allow the American people to see/hear the Hur Interview with Biden? They can then decide for themselves, if Biden is capable of leading! After all, Biden campaigned in 2020 on his promising to have Full Transparency if he obtained the office!
