John Weaver, Kaitlyn’s heartbroken father, has publicly condemned the DA’s handling of the case. Initially, he was told there would be “no plea offer” from prosecutors. That changed without warning. “They said by doing two years’ probation, that’s probably more than the judge would give if he pleaded guilty,” he told reporters. “You don’t have to participate in a bad system. If the judge wanted to sentence him to less, that’s the judge’s issue. What happened in this case is you (prosecutors) created it into your issue. Now you’re part of the problem.”

The Weaver family was blindsided by the sudden shift in legal strategy—a move that appeared to prioritize the future of a criminal over the memory and life of the victim.

In a shocking development that should have happened from day one, Immigration and Customs Enforcement (ICE) announced that they had arrested the 16-year-old killer, along with members of his family. ICE officers are now holding him in custody, pending an immigration hearing.

“For the [Arapahoe County District Attorney’s Office] justice is no jail time and probation for this criminal alien who killed a young woman while driving more than 90 mph,” ICE officials posted on X. “For ICE, justice is arrest and removal. A 16-year-old citizen of Colombia, with a conviction for reckless driving resulting in death was arrested by ICE Denver officers last week and will remain in ICE custody pending an immigration hearing.”

It’s a brutal reminder that America’s justice system is often more forgiving of illegal alien offenders than it is protective of innocent American citizens. And many are asking: if DHS hadn’t intervened, would this killer still be walking free?

“In the juvenile system, it’s all about rehabilitation. It’s not about deterrence. It’s not about any type of justice or other thing,” said John Weaver. “When they balance this weight of my daughter versus the defendant, it really does favor the defendant in looking at their potential for rehabilitation as opposed to my daughter who’s no longer with us.”

Kaitlyn’s story has touched millions, and her father expressed his gratitude to the public and to ICE for stepping in when the justice system failed. But the broader question remains: how many more families have to bury their children before justice stops favoring criminals over victims?

This isn’t just a failure of one DA—it’s the symptom of a broken, politically motivated legal system that bends over backward to protect those who shouldn’t be here in the first place, while ignoring the blood left on the pavement.
