As Florida’s 2024 election looms, Governor Ron DeSantis is confronting a major issue that could shape the future of the state’s abortion laws. A controversial ballot measure, Amendment 4, is gaining momentum among voters, posing a significant challenge to DeSantis’s efforts to maintain a strong grip on Florida’s conservative policies.
Amendment 4, if passed, would enshrine a constitutional right to an abortion up until fetal viability—roughly 23 weeks. Recent polling from Emerson College shows growing support for the measure, with 53.2% of voters planning to vote in favor, compared to 29.8% opposed. This marks a significant increase from earlier this year when support was at 42.4%. The surge in backing has sparked concern among DeSantis and his allies.

The American Civil Liberties Union (ACLU) in Florida is celebrating the rise in voter support. Keisha Mulfort, the organization’s senior communications strategist, said, “In poll after poll, we’re encouraged to see that the overwhelming majority of Floridians support ending Florida’s extreme abortion ban by passing Amendment 4.” She went on to suggest that voter turnout will be a critical factor in the outcome, given “the state’s coordinated effort to spread misinformation and confuse voters.”
