On Monday, Judge James Boasberg refused the Trump Administration’s request to lift a temporary restraining order (TRO) that had been preventing the deportation of certain criminal aliens. Instead of tossing the TRO altogether, Boasberg offered to convert it into a preliminary injunction—a legal technicality that could now allow the Trump team to challenge the ruling in a higher court.

For context, temporary restraining orders are typically not appealable. But if Boasberg turns it into a preliminary injunction, it opens the door for the Trump Administration to fight back in appellate court. They’ve been given until March 26 to decide their next move.

But here’s the kicker: Judge Boasberg insists that even criminal aliens being deported under the Alien Enemies Act are somehow entitled to “individual hearings.” Yes, you read that right. According to this Obama-appointed judge, illegal aliens with criminal records deserve full-blown court hearings—essentially giving them more process than many law-abiding Americans would get.
