The interruptions from Muir and Davis during Trump’s responses, many of which were later fact-checked and found to be inaccurate, further fueled the controversy. On the other hand, Harris was reportedly able to make false claims without interruption. This has led critics, including Penn, to question whether the debate was rigged to favor the Vice President.
Penn went on to suggest that ABC News should launch an internal review, citing the need for an independent party to examine the network’s internal communications. He proposed that such a review would help determine whether the moderators had coordinated with the Harris campaign or planned to undermine Trump in advance.
“I think the day after, suspicion here is really quite high, and I think a review of all their internal texts and emails really should be done by an independent party to find out to what extent they were planning on, in effect, you know, fact-checking just one candidate and in effect, rigging the outcome of this debate. I think the situation demands nothing less than that,” he said.
In an editorial co-authored with Andrew Stein, former New York City Council president, Penn elaborated on his concerns. The piece, published in the Wall Street Journal, argued that the debate moderators appeared to have made up their minds before the event to scrutinize Trump more aggressively while giving Harris a free pass.
“[Harris] enlisted every charge ever leveled against Mr. Trump, regardless of the truth,” Penn and Stein wrote. They listed several false claims Harris made, such as accusing Trump of supporting a national abortion ban, calling neo-Nazis in Charlottesville “very fine people,” and threatening a “bloodbath” if he lost the election—all of which were debunked. “Each is untrue: Mr. Trump has made clear he opposes a national abortion ban. He favors IVF and has even said the government should pay for it. He condemned the Charlottesville neo-Nazis. And he predicted a financial ‘bloodbath’ for the auto industry if he loses and the Biden-Harris electric-vehicle mandates progress.”
According to Penn, the debate could have taken a different turn had the moderators called out Harris’s misleading statements. “Had the moderators turned to Ms. Harris after her lies and said, ‘That has been debunked,’ we might be having a totally different conversation about the debate, given how she tends to react when challenged,” Penn and Stein argued in their editorial. They added that Trump’s performance could have been stronger had he not spent so much time defending himself against false charges.

Prominent political figures have weighed in on the debate’s moderation, with some even likening it to a “three-on-one” situation. Florida Governor Ron DeSantis, Democratic presidential candidate Robert F. Kennedy Jr., and Trump himself have all criticized the event as unfairly stacked against the former president. Despite the controversy, Trump maintained confidence in his performance, asserting that he had “won the night” and emerged victorious.
The debate controversy continues to stir conversations about media bias and fairness in political discourse, with calls for ABC News to hold itself accountable growing louder by the day.
