Boston Judge Who Shielded Migrant Just Got BAD News!

The high-stakes hearing is being held in Suffolk Superior Court, with Judge Denis McInerney presiding. McInerney will compile a report summarizing his findings and recommendations once the proceedings conclude.

At the opening of the hearing, Joseph’s defense attorney made it clear that his client has not been convicted of any crime. Still, he acknowledged the explosive reputation the case has taken on in Massachusetts.

“If you were to walk down the street and take a survey of the people you meet, 100% of them would tell you Judge Joseph let an illegal immigrant out the back door of the district court,” her attorney said. “Fifty percent of them would say she’s a criminal and should go to jail. Fifty percent would call her a folk hero for what she gave. But she definitely did it.”

He continued, “It has become such a part of local lore in Boston that the media, for the most part, have dropped the niceties of alleged or charged, and they report and make references to this incident as if a dozen people had seen Judge Joseph get off the bench, escorted the defendant to the door, gave him a hug and wished him Godspeed.”

Federal prosecutors allege that Joseph intentionally obstructed the ICE officer’s attempt to arrest Medina-Perez. They claim she instructed a clerk to tell the ICE agent to wait in the courthouse lobby, implying that if the defendant were released, he would exit through that same area.

Then, according to court documents, Joseph ordered the court clerk to “go off the record for a moment.” The courtroom’s audio recorder was switched off for 52 seconds. When the recording resumed, Joseph announced she was freeing the defendant.

Prosecutors stated that the defendant’s lawyer asked to speak privately with Medina-Perez downstairs, to which Joseph responded, “That’s great. Of course.”

When told that an ICE agent was stationed in the lobby awaiting the man’s release, Joseph allegedly replied, “That’s OK. I will not allow them to enter here. But he’s been freed on this.”

Court records show that a court officer, identified as Wesley MacGregor, then led Medina-Perez, his attorney, and a translator to the courthouse’s basement lockup area. MacGregor allegedly used his security card to open a rear sally-port door, allowing Medina-Perez to walk out undetected.

Federal prosecutors eventually dropped the criminal charges against Joseph in 2022 after she admitted to key details of the incident and reported herself to the Massachusetts Commission on Judicial Conduct (CJC). But the CJC later filed its own civil charges, accusing her of “willful judicial misconduct” and conduct “prejudicial to the administration of justice.”

The controversy has reignited debate over the judiciary’s role in immigration enforcement—and whether liberal judges are protecting illegal immigrants from federal law.

This isn’t the first time a judge has faced serious consequences for allegedly helping illegal aliens evade ICE. In 2023, Milwaukee County Judge Hannah Dugan was arrested for allegedly helping an undocumented man avoid arrest. Likewise, New Mexico Judge Joel Cano and his wife were charged with harboring an illegal alien with suspected gang ties.

Now, Massachusetts is once again under the national spotlight. The outcome of Judge Joseph’s misconduct hearing will determine not only her future on the bench—but also send a clear message about whether justice still applies equally to everyone, or only to those the political establishment chooses to protect.
