President Trump’s powerful proclamation to secure America’s borders and put a stop to the flood of illegal immigrants just hit a major roadblock. On Wednesday, an Obama-appointed judge struck down Trump’s emergency declaration that labeled the border chaos for what it really is—an invasion.
U.S. District Judge Randolph Moss—appointed under Barack Obama—handed down a ruling that torpedoes the former president’s latest attempt to clamp down on the growing crisis at the southern border. Moss claimed that Trump “exceeded his legal authority” when he declared an invasion on January 20 and implemented tough restrictions on asylum claims.
In his decision, the judge blocked a range of measures that were intended to tighten up the nation’s asylum process and shut down abuse by illegal border crossers.
Trump’s proclamation was straightforward: stop rewarding illegal behavior and prioritize lawful immigration. Under his order, migrants who entered between ports of entry would have been ineligible to claim asylum. Even those who came through proper checkpoints would face stricter scrutiny to prevent exploitation of the system.
