Trump signed the “Restoring America’s Fighting Force” and “Prioritizing Military Excellence and Readiness” executive orders last month, directing the U.S. military to operate without preferences based on race or sex and to eliminate gender ideology from military policy. These orders reinforce traditional military standards, requiring all service members to meet rigorous mental and physical fitness requirements.

The executive order mandates the Secretary of Defense to uphold strict guidelines, ensuring military service is “reserved for those mentally and physically fit for duty.” It further directs the Pentagon to eliminate “invented and identification-based pronoun usage.”

“It is the policy of the United States Government to establish high standards for troop readiness, lethality, cohesion, honesty, humility, uniformity, and integrity,” the order states. “This policy is inconsistent with the medical, surgical, and mental health constraints on individuals with gender dysphoria. This policy is also inconsistent with shifting pronoun usage or use of pronouns that inaccurately reflect an individual’s sex.”

Judge Reyes aggressively questioned Department of Justice attorneys over the administration’s stance on gender identity in the military.

“If you were in a foxhole, you wouldn’t care about these individuals’ gender ideology, right?” Reyes pressed DOJ lawyers.

The judge refrained from issuing a ruling on Tuesday but signaled strong opposition to the executive order, raising doubts about whether limiting transgender participation would impact military readiness.

ABC News reported: “A federal judge appears poised to block the Trump administration if the Department of Defense attempts to place limitations on or ban transgender service members.”

Reyes displayed skepticism toward the argument that transgender policies affect military strength and cohesion, questioning whether a small fraction of service members using different pronouns could truly hinder the U.S. military—the most powerful fighting force in history.

“You and I both agree that the greatest fighting force that world history has ever seen is not going to be impacted in any way by less than 1% of the soldiers using a different pronoun than others might want to call them. Would you agree with that?” Reyes asked during the hearing.

“No, Your Honor, I’m not. I can’t agree with that,” a DOJ lawyer responded.

Trump’s Jan. 27 executive order instructs the Department of Defense to update policies concerning transgender medical standards for military service. While the Pentagon has yet to finalize its guidance, the order has already halted gender-affirming care for service members and is expected to impose strict limitations based on readiness and combat effectiveness.

The debate over gender identity in the military has ignited a broader national discussion about the role of political ideology in the armed forces. Critics argue that prioritizing gender ideology over combat effectiveness undermines military preparedness. Supporters of the Biden-appointed judge, however, contend that banning transgender individuals from service is discriminatory and unrelated to military performance.

With the Department of Defense expected to finalize its policies in the coming weeks, this legal battle could set a precedent for how the military approaches gender identity and fitness for duty in the future.
