In a major development in the legal battles surrounding former President Donald Trump, the Georgia Court of Appeals has disqualified Fulton County District Attorney Fani Willis and her entire office from prosecuting Trump in the RICO case related to alleged election interference. While the charges themselves remain intact, Willis and her team have been stripped of their authority to proceed with the case.
Appearance of Impropriety Leads to Disqualification
The appeals court ruled that the disqualification stemmed from an “appearance of impropriety,” stating that such an appearance undermines public confidence in the justice system. According to the court filing:

“After carefully considering the trial court’s findings in its order, we conclude that it erred by failing to disqualify DA Willis and her office. The remedy crafted by the trial court to prevent an ongoing appearance of impropriety did nothing to address the appearance of impropriety that existed at times when DA Willis was exercising her broad pretrial discretion about who to prosecute and what charges to bring.”
