In its order, the court stated, “The Court finds Defendant [Willis, in her official capacity] is in default and has been since 11 April 2024.” It further noted that Willis “never moved to open default on any basis,” nor did she offer a meritorious defense or pay associated costs.

The court’s judgment effectively deemed Willis in violation of Georgia’s Open Records Act (ORA). It ordered her to conduct a thorough search for the requested records within five business days. Additionally, the court directed Willis to release all responsive documents unless exempted by law. If any records were withheld, Willis was instructed to provide a detailed explanation for their absence or exemption.

Judicial Watch President Tom Fitton expressed astonishment at the court’s decision. “Fani Willis is something else. We’ve been doing this work for 30 years, and this is the first time in our experience a government official has been found in default for not showing up in court to answer an open records lawsuit,” he said.

Fitton emphasized the importance of the lawsuit, adding, “Judicial Watch looks forward to getting any documents from the Fani Willis operation about collusion with the Biden administration and Nancy Pelosi’s Congress on her unprecedented and compromised ‘get-Trump’ prosecution.”
