In a pivotal decision, the U.S. Supreme Court on Monday declined to hear X’s challenge against Special Counsel Jack Smith’s secret search warrant targeting former President Donald Trump’s account on the platform formerly known as Twitter. This move leaves in place a lower court ruling that upheld a nondisclosure order, which prevented X from informing Trump about the government’s request for his account information.
Earlier reports indicate that Special Counsel Jack Smith may have included inaccurate information when seeking the secret search warrant from Judge Beryl Howell, an appointee of former President Barack Obama. As a result of delays in producing the subpoenaed records, X was fined $350,000. The secrecy surrounding the warrant was so extensive that Trump remained unaware of the subpoena issued for his account, @RealDonaldTrump.

Throughout the prolonged legal battle, X argued that the nondisclosure order violated the First Amendment and the Stored Communications Act. The company contended that social media platforms should not be compelled to provide user data and private communications to the government without informing the user. In contrast, the Justice Department maintained that notifying Trump would jeopardize the ongoing investigation.
