The Arizona Supreme Court responded by ruling that these voters should be moved to the “Federal-Only” voting list, allowing them to vote in federal elections but preventing them from participating in state and local elections until their citizenship status could be verified. The court’s ruling also authorized further investigations into whether these voters had, in fact, provided the required proof of citizenship.

America First Legal wasted no time in taking action. Within hours of Richer’s filing, AFL filed a public records request on behalf of EZAZ.org, demanding that Secretary Fontes release the full list of individuals who had registered to vote unlawfully. However, their request was met with resistance. Fontes’s attorney responded with what AFL described as “a bombastic tirade,” accusing EZAZ.org of harboring a secret agenda to harass the individuals on the list. AFL dismissed these claims as baseless, stating, “There is, of course, no evidence to support Secretary Fontes’s conspiracy theory, and EZAZ.org has no intention of harassing anyone.”

In the letter, Fontes also claimed that producing the list would be too burdensome for his staff. AFL quickly refuted this, pointing out that the Secretary of State’s office had already compiled the list, which is how they were able to determine the number of affected voters in the first place. AFL emphasized that EZAZ.org’s mission is to protect voters, not harass them, and accused Fontes of making excuses to avoid transparency.

On September 30, Fontes admitted that the problem was even larger than initially reported. He revealed the discovery of an additional “new set of approximately 120,000 Arizonans” who may have been affected by a data coding error in the databases of Arizona’s Department of Transportation (ADOT) and Motor Vehicle Division (MVD). This brought the total number of potentially unlawfully registered voters to a staggering 218,000.

To put this in perspective, Arizona was won by just 10,457 votes in the 2020 presidential election. The possibility that such a large number of votes could be in question has raised alarms about the state’s election integrity and the potential for future election interference.

In response to the lawsuit, America First Legal President Stephen Miller reiterated the importance of safeguarding the voting process. “America First Legal continues to lead the fight for election integrity. We are suing the state of Arizona for refusing to provide the list of 218,000 voters who failed or refused to establish citizenship. It is absolutely imperative that we stop the dire threat of illegal alien voting, which is the gravest form of foreign election interference,” Miller said.

As the lawsuit moves forward, the outcome could have significant implications not only for Arizona but also for the broader national conversation surrounding voter integrity and the security of American elections.
