This approach draws on Immigration and Nationality Act sections 212(f) and 215(a) to block migrants who cross the southern border unlawfully from obtaining asylum under circumstances deemed excessive by the administration. A senior official pointed out the reliance on the same statutes used by the Trump administration, though the current measures are described as more humane and temporary.

“I will never demonize immigrants. I’ll never separate children from their families at the border. I will not ban people from this country because of their religious beliefs,” President Biden emphasized, distinguishing his policies from those of his predecessor.

The specific triggers for these new border control measures include the average daily migrant encounters exceeding 2,500 for a consecutive week, with the restrictions remaining until the number falls below 1,500 for the same duration. Noteworthy exceptions include individuals who express a credible fear of persecution or torture and unaccompanied minors.

The new protocol also opens avenues for lawful entry through programs like the CHNV asylum program and the CBP One app, which facilitate the entry of thousands monthly and daily, respectively. Officials reassured that the U.S. would maintain its international obligations by screening individuals found ineligible for asylum for other forms of protection.

Highlighting the broader scope of these measures, administration officials noted their applicability to migrants from beyond the Western Hemisphere, ensuring swift repercussions for unauthorized entries from any nation.

Moreover, Biden touted ongoing collaborations with Mexico and other Latin American nations to mitigate immigration pressures and confirmed continued cooperation with Mexico’s incoming President-elect Claudia Sheinbaum.

This executive order emerges in the wake of failed bipartisan legislation intended to address similar issues. The failed bill, opposed by figures like Rep. Eric Schmitt (R-Mo.), sought to establish stringent entry thresholds and enhance border security staffing.

Senior administration officials criticized the legislative deadlock, attributing it to partisan politics and a reluctance to grant the Biden administration a perceived political victory.

Amidst these developments, former President Donald Trump critiqued Biden’s border policies as ineffectual. “Crooked Joe Biden has totally surrendered our Southern Border,” Trump declared on Truth Social, accusing Biden of allowing widespread and dangerous entries into the country.
