Democrats have spent years trying to frame this as a legitimate prosecution—but there’s a constitutional problem they don’t like to talk about.
Jack Smith was never legally empowered to serve as a special counsel. In July 2024, Cannon ruled that Garland lacked statutory authority to designate Smith, effectively giving a private citizen U.S. Attorney-level prosecutorial power without a presidential nomination or Senate confirmation. Cannon determined the regulatory framework used to justify the appointment had no valid basis in federal law.
