Trump tapped Lindsey Halligan to lead the U.S. Attorney’s Office for the Eastern District of Virginia last month, following the resignation of Erik Siebert. Since taking over, Halligan has aggressively pursued legal action against several figures — including Comey himself.
The White House has made clear where it stands. A spokesperson told Axios the president fully supports his appointee.
“This is a frivolous and desperate attempt by Comey to distract from the facts of his case that even a grand jury recognized,” the spokesperson said in an emailed statement.
The courtroom showdown is expected to become one of the most closely watched legal battles of President Trump’s second term. U.S. District Judge Michael Nachmanoff — a Biden appointee — has been assigned to oversee the case.
Nachmanoff is not your typical judge. A fourth-degree black belt in Shotokan Fudokan karate, he is known for remaining calm under intense pressure. Those who have worked with him describe him as a disciplined and even-tempered jurist — a critical quality in a case guaranteed to be politically charged.
On Wednesday morning, Nachmanoff presided over Comey’s arraignment in the Alexandria federal courthouse. The former FBI director now faces serious federal charges, including making false statements and obstructing a congressional proceeding.
Throughout his career, Nachmanoff has earned a reputation in Virginia’s legal community as a careful and balanced judge. Before becoming a district judge, he served as a magistrate in the same courthouse, gaining years of experience handling sensitive cases.
Legal professionals who have argued before him say he keeps his political opinions close to the vest. CNN quoted multiple attorneys who praised his focus on the law rather than politics — something that may be put to the ultimate test with Comey’s prosecution.
“I would call him an apolitical judge,” Kevin Carroll, a Virginia attorney, told CNN. Carroll previously sought emergency relief in Nachmanoff’s courtroom and noted that “The judge hasn’t brought politics into it at all. It’s just been straight legal discussion.”
Robert Jenkins, a white-collar defense attorney familiar with Nachmanoff’s courtroom, echoed those sentiments. He said the judge “is committed to getting things right and making sure that justice is served.”
“When I learned about the case being assigned to him, I had a great sense that if this is just a politically motivated prosecution, he will discover the right way to deal with it, to make sure that justice is served,” Jenkins added. “If there is some true merit to the allegations contained in the indictment, I think he will do likewise, because he is fair and committed to doing the right thing.”
The indictment against Comey was returned by a Washington, D.C. grand jury — a jurisdiction overwhelmingly dominated by Democrats. That fact alone has already raised eyebrows among Trump supporters, who view the proceedings through a lens of long-simmering political battles between Trump and the FBI establishment.
Judge Nachmanoff was one of President Biden’s earliest judicial nominees and was confirmed to the bench with bipartisan support in 2021. Three Republican senators joined Democrats in backing his lifetime appointment.
Now, he finds himself at the center of a politically explosive legal drama involving one of the most controversial figures of the Trump era.
