Free Speech: The Conservative Line in the Sand

Several leading voices on the Right immediately spoke out. Radio host Jesse Kelly didn’t mince words: “I would never in a million years harm the American flag. But a president telling me I can’t has me as close as I’ll ever be to lighting one on fire. I am a free American citizen. And if I ever feel like torching one, I will.”

Erick Erickson, another conservative commentator, was just as blunt: “This is actually not brilliant. While I agree with the sentiment, it is unfortunately well settled constitutional law that burning the flag is a matter of free speech.”

And Dana Loesch, a staunch conservative radio host, said what many were thinking: “Flag burning is vile but the government has no right to control speech or expression.”

These aren’t “Never Trumpers” seizing an opportunity to attack. These are die-hard conservatives who see the Constitution as bigger than any one President — even one they support.

The Supreme Court Already Decided This

The problem for Trump is simple: the Supreme Court already ruled on this issue in Texas v. Johnson (1989). Burning the American flag is considered symbolic speech, and it’s protected under the First Amendment. No executive order can sidestep Supreme Court precedent.

White House spokesperson Taylor Rogers attempted to defend the order, saying Trump would “always protect the First Amendment” while implementing “tough-on-crime policies.” But critics say that’s impossible if the order itself undermines free speech.

Once the government starts deciding which symbols are too sacred for criticism, freedom of expression ceases to exist. At that point, we’re left with government-approved speech — and nothing more.

Conservatives Warn Against Double Standards

The frustration is understandable. Americans have watched prosecutors go soft on rioters while hammering conservatives for far less. Readers on Fox News pointed out that Pride flag destruction often brings charges, while burning the U.S. flag is applauded as “resistance.”

That double standard is real, but the answer isn’t more government speech control. The answer is to demand free speech protections apply evenly — even for views we despise. That’s the conservative principle.

The Danger of Using the Left’s Playbook

For years, conservatives have fought against government overreach, Big Tech censorship, and FBI targeting of parents. Now Trump risks turning those same powers against the other side. That’s not constitutional leadership — that’s just shifting who gets to hold the weapon.

Conservative writer Bonchie summed it up: “I know nothing matters and you aren’t allowed to criticize your own side, but I’d like to return to a time when presidents didn’t sign unconstitutional executive orders for show.”

The Bottom Line

No one doubts Trump’s record on the Constitution. His judicial appointments alone have reshaped the courts for generations. But good presidents can still make mistakes — and real conservatives are willing to say so.

The flag matters because it symbolizes the freedoms guaranteed in the Constitution. Shredding those freedoms to “protect” the symbol empties it of meaning. We don’t honor veterans by restricting the liberties they fought to defend. We honor them by living out those principles — even when it means tolerating speech that makes us sick.

On this issue, Trump got it wrong. And the conservatives speaking up aren’t betraying him — they’re staying true to the Constitution. That’s what principled leadership looks like, and it’s exactly what America needs now.
