Governor Abbott made it crystal clear that lawmakers who intentionally abandon their posts to block the people’s work are flirting with the legal edge of forfeiting their seats.
“Democrats hatched a deliberate plan not to show up for work, for the specific purpose of abdicating the duties of their office and thwarting the chamber’s business. That amounts to an abandonment or forfeiture of an elected state office,” Abbott stated.
According to Abbott, these absences are not accidental, nor are they caused by illness or family emergencies. They are calculated, deliberate, and designed to block the people’s voice.
“Real Texans do not run from a fight. But that’s exactly what most of the Texas House Democrats just did,” he added in a full statement.
Abbott reminded the rogue lawmakers that the Texas Constitution demands that when the Governor calls a Special Session, the legislature is required to show up.
“It’s not optional. It’s a duty,” Abbott emphasized. “The absconded Democrat House members were elected to meet and vote on legislation—not to prevent votes that may not go their way.”
He blasted the Democrats for behaving like “truants” and warned they must return by 3:00 PM on Monday, August 4, 2025. If not, the hammer may come down.
Citing Texas Attorney General Opinion No. KP-0382, Abbott laid out the path forward to remove lawmakers who intentionally vacate their responsibilities.
“Through a quo warranto action, a district court may determine that a legislator has forfeited his or her office due to abandonment and can remove the legislator from office, thereby creating a vacancy,” Abbott said.
Under this legal doctrine, Abbott would be empowered to fill those vacancies immediately under Article III, Section 13 of the Texas Constitution.
Governor Abbott also dropped another bombshell—some of these fleeing Democrats may be skirting felony territory. He pointed to fundraising efforts that aim to cover potential fines incurred by their absence as potentially violating Texas bribery laws.
“Any Democrat who ‘solicits, accepts, or agrees to accept’ such funds… may have violated bribery laws,” Abbott warned. He also noted that donors offering money to help them evade legislative duties could be implicated too.
And if that weren’t enough, Abbott didn’t rule out extradition either.
Governor Abbott has made it clear—he will not stand by as elected officials walk away from their responsibilities. Democrats who chose to play political games rather than do their job may soon find themselves jobless, and possibly facing legal trouble.
In a time when political theater has taken center stage, Texas is fast becoming the proving ground for what happens when one side refuses to play by the rules—and the other refuses to let them get away with it.
