The charge: lying to Congress during sworn testimony about his involvement in a controversial 2020 state report that effectively cleared him of blame for the deaths of over 15,000 elderly nursing home residents.
Back in July 2020, Cuomo’s administration released a report downplaying the role his executive order played in those deaths. The order had forced nursing homes to accept COVID-positive patients, a decision many experts now agree was disastrous. But the report shifted the blame away from Cuomo’s policies, instead pointing to community transmission and staff infections.
Cuomo testified in 2024 that he had nothing to do with the report’s creation or edits. But damning witness testimony from his own inner circle says otherwise.
“So, based on the documents that we reviewed today, was former Governor Cuomo involved in the drafting of the July 6th report in any capacity?” a committee lawyer asked former executive assistant Farrah Kennedy.
“Yes,” Kennedy replied.
“Who worked on editing the report?” another lawyer asked Cuomo’s close advisor Dr. Jim Malatras.
“I did, Beth Garvey, Governor Cuomo,” Malatras confirmed.
The revelations didn’t stop there. When asked directly if Cuomo reviewed and edited the report multiple times, Malatras doubled down.
“Yes,” he answered.
These contradictions are now at the core of the Department of Justice’s newly launched criminal investigation. Comer’s referral has put the wheels of justice in motion, and Attorney General Bondi appears ready to take it all the way.
“Let’s be clear: lying to Congress is a federal crime. Mr. Cuomo must be prosecuted to the fullest extent of the law. The House Oversight Committee is prepared to fully cooperate with the Justice Department’s investigation into Andrew Cuomo’s actions and ensure he’s held to account,” Comer stated.
But Cuomo’s camp is crying foul, claiming this is nothing more than political warfare. His spokesman Rich Azzopardi lashed out at the investigation.
“We have never been informed of any such matter, so why would someone leak it now? The answer is obvious: This is lawfare and election interference plain and simple — something President Trump and his top Department of Justice officials say they are against.”
He continued:
“Cuomo testified truthfully to the best of his recollection about events from four years earlier, and he offered to address any follow-up questions from the subcommittee — but from the beginning this was all transparently political.”
Despite the pushback, the seriousness of the allegations cannot be ignored. A top Democrat allegedly lying under oath to cover up his role in a state-sanctioned tragedy—this is no mere political chess game. It’s a scandal with real victims and potentially criminal consequences.
Now, as Cuomo eyes a political comeback—polls even show him leading in a potential bid for New York City mayor—his past may catch up with him in the most dramatic way yet.
With a criminal probe now officially underway, all eyes are on the Justice Department. Will it have the backbone to hold Cuomo accountable? Or will this be yet another instance of selective justice in Biden’s America?
