“I actually like the Chief Justice. I clerked for Justice [Neil] Gorsuch, and I like him personally, John Roberts, but I would say this to the Chief Justice: you have failed to do your job as the Chief Justice of the United States when you have allowed these radical activist judges to sabotage the president’s Article II powers,” Davis stated, reflecting on his concerns about Roberts’s inaction.

Davis didn’t hold back in his criticism, asserting that federal judges who repeatedly block the president’s agenda are not engaged in judicial review but are instead engaging in “judicial sabotage.” He continued, “This is an assault on American voters. This is a repudiation of American voters by lifetime appointment, paycheck-protected federal judges who have no—who have no reason to be in this political lane. This is not judicial review. This is judicial sabotage.”

In a striking remark directed at these judges, Davis warned: “And I say this to these judges: when you take off your judicial robes, climb into the political arena, and throw political punches, expect powerful political counterpunches from the Article III Project because this is unacceptable.” He made it clear that any move by judges to become political players would face a strong response from his organization.

Davis also questioned the practical implications of the ongoing judicial interference, asking, “Is the president supposed to report to 670 district court judges around the country for everything he does?” He went on to describe the situation as “insane,” arguing that the number of nationwide injunctions, particularly those coming from Obama-era appointees, represents an unprecedented obstruction of the executive branch.

Piscopo, clearly interested in the legal maneuvering behind these actions, asked Davis if he was collaborating with White House Deputy Chief of Staff Stephen Miller on the lawsuit. Davis responded cautiously, acknowledging the potential involvement of Miller’s America First Legal organization but refraining from revealing too much.

“I have to be careful what I say on particular lawsuits on who I’m working with,” Davis responded, noting that the Article III Project operates as an independent entity despite its alignment with President Trump.

Davis went on to reiterate the Article III Project’s commitment to supporting the President, citing their past efforts in defending him against “unprecedented Republican lawfare” during the first term. Reflecting on Trump’s comeback, Davis proudly declared, “We turned lemons into lemonade. Everyone thought Trump was toast after the Mar-a-Lago raid, and now he’s back in the White House, and we’re going to continue to support President Trump every step of the way, every day for the next four years to make sure he succeeds.”

The America First Legal lawsuit is part of a broader legal battle where Trump and his allies have repeatedly challenged what they see as judicial overreach by “activist” judges. Many of these judges, appointed by Democratic presidents, have issued injunctions against Trump’s policies, something that was virtually unheard of before his presidency. However, Davis and others in the conservative movement are vowing to fight back against what they view as a systematic effort to block the will of the American people as expressed in the 2016 and 2020 elections.
