Mike Davis, the head of the Article III Project and a former law clerk for Justice Neil Gorsuch, has accused Chief Justice John Roberts of allowing lower federal courts to undermine President Donald Trump’s second-term agenda. In an eye-opening interview with actor and comedian Joe Piscopo, Davis took aim at Roberts, claiming the Chief Justice has failed to reign in “radical activist judges” who have sought to block Trump’s policies.
Davis’s criticism comes in light of a recent lawsuit targeting Roberts in his role as head of the U.S. Judicial Conference, a body responsible for overseeing the judiciary’s administrative functions. The lawsuit, filed by America First Legal, also names Robert J. Conrad, the director of the Administrative Office of the U.S. Courts. The complaint accuses these bodies of overstepping their constitutional boundaries by engaging in regulatory actions that go beyond the judicial system’s core responsibilities.
At the heart of the lawsuit is the contention that the records kept by the Judicial Conference should be open to public scrutiny under the Freedom of Information Act (FOIA), due to the alleged unlawful actions carried out by the Conference under Roberts’ leadership.
During his conversation with Piscopo, Davis leveled sharp accusations against Roberts, claiming the Chief Justice has turned a blind eye to the growing trend of nationwide injunctions against the Trump administration. These injunctions, which have become a hallmark of judicial opposition to the Trump agenda, have been imposed by lower courts throughout the country, even though Davis argues that they infringe upon the President’s Article II powers.
