In a major legal victory for former President Donald Trump, the D.C. Circuit Court of Appeals has overturned an Obama-appointed judge’s attempt to reinstate a Biden-era holdover. The appeals court issued a stay against Judge Amy Berman Jackson’s ruling, which sought to declare Trump’s firing of Hampton Dellinger illegal.
Dellinger, who was serving as the Special Counsel for the Office of Special Counsel (OSC)—a position distinct from special counsels assigned as federal prosecutors—was removed by Trump last month. His termination sparked legal battles that reached the D.C. Circuit Court, where a three-judge panel stepped in to halt Jackson’s ruling. The panel included Judge Karen Henderson, a George W. Bush appointee, Judge Patricia Millett, an Obama appointee, and Judge Justin Walker, a Trump appointee. Their opinion is expected to be released soon.

Earlier in the week, Jackson, an Obama-era judge with a history of ruling against conservatives, issued a decision in favor of Dellinger. On Saturday, she doubled down by formally entering a judgment declaring Trump’s decision to remove him unlawful.
