Former President Donald Trump’s capacity to speak publicly before his trial for suspected election tampering has been restricted by federal judge Tanya S. Chutkan, who was chosen by former President Barack Obama. Prosecutors voiced worries about potential alterations to the judicial procedures, which led to this ruling.
Trump and his friends are no longer able to disparage Judge Chutkan’s staff, Special Counsel Jack Smith, or court officials. This ban also covers any remarks made against their relatives.
Trump has the right to claim that “this prosecution is politically motivated,” according to Judge Chutkan, but he is not allowed to refer to the prosecutor as a “thug” or conduct in a manner that would suggest that the prosecutor is politically motivated. “Vilify and implicitly encourage violence against public servants who are simply doing their jobs.”
Rep. Marjorie Taylor Greene (R-GA) expressed her worries on the effects of the gag order on the right to free speech. From the federal courthouse in Washington, she tweeted: “I’m here… to see if Judge Chutkan is really going to destroy the 1st amendment – free speech rights of former President Trump and leading candidate for President in 2024.”

The chief prosecutor has been referred to by Trump as “deranged Jack Smith,” and he has been charged with being politically biased in his investigations into him. Another case against Trump, including the improper handling of sensitive papers at Mar-a-Lago, is also under Smith’s supervision.

Trump had already received a warning from Judge Chutkan on his comments, and he even offered the possibility that the trial would be expedited to avoid any potential jury bias.

On the second day of the continuing fraud trial, Engoron spoke with Trump’s defense team, “Consider this statement a gag order on all parties with respect to posting or publicly speaking about any member of my staff.” The Judge specifically objected to a post by Trump to Truth Social that attacked Ashley Greenfield, the chief legal clerk for Engoron, and shared a photo of her with Senate Majority Leader Chuck Schumer (D-NY).

According to CNBC, the Trump team then sent out an email denouncing Engoron harshly as a “Far-Left Democrat,” giving a long list of news sources that had previously exposed the Judge’s vast Democrat affiliations and political predisposition. Trump then stated that Letitia James, the attorney general of New York, “should probably be dismissed also” after receiving harsh criticism for her plainly political persecution of his family.
Gag orders, according to Trump’s legal team, may create a dangerous precedent and prevent the front-runner from addressing the crucial issues affecting his campaign. Given that many GOP members agree with Trump’s assertion that these accusations are politically motivated, this may significantly complicate the GOP’s campaign for the nomination.
