The deadly incident followed Descano’s office dropping charges of malicious wounding and brandishing a firearm against Morales-Ortez on December 16.⁴ ICE had filed a detainer requesting that Fairfax authorities hand the suspected gang member over to federal custody. County officials ignored the request and released him onto the streets.
“The charges were nolle prossed due to insufficient evidence to move forward with the criminal case,” a spokesperson for Descano’s office told Fox News Digital.⁵
The alleged victim in the September assault case reportedly had moved out of the country and refused to cooperate with authorities.
A History of Criminal Behavior
This wasn’t Morales-Ortez’s first encounter with law enforcement under Descano. Court records reveal at least seven charges in Fairfax County since 2020.⁶ This includes a 2021 first-degree murder charge for killing Jose Lorenzo Guillen Mejia. Morales-Ortez spent 18 months in jail awaiting trial before Descano’s office dropped the charges.
His only conviction in five years? A minor theft charge carrying a $300 fine he never paid.⁷
DHS: Sanctuary Officials “Have Blood on Their Hands”
The Department of Homeland Security didn’t hold back in condemning Fairfax officials.
“This is nothing more than sanctuary politicians trying to pass the blame for their REFUSAL to protect American citizens,” a DHS spokesperson said.⁸ “The sanctuary politicians of Fairfax have blood on their hands. They should have turned this serial criminal illegal alien over to ICE law enforcement — instead they chose to RELEASE him back into Virginia neighborhoods.”
Sheriff Stacey Kincaid’s office claimed ICE needed a judicial warrant to hold Morales-Ortez beyond his court-ordered release, but federal officials rejected that argument.
“To honor a detainer, officials do NOT need a judicial warrant,” DHS fired back.⁹
Fairfax County is notorious for ignoring ICE detainer requests, ranking third in the nation according to the Center for Immigration Studies.¹⁰
“Fairfax County has been an egregious sanctuary jurisdiction for quite some time,” said Jessica Vaughan, the center’s policy studies director. “This latest case is the worst-case scenario all over again, with someone in the country illegally who’s been arrested multiple times for some serious offenses, who gets released despite an ICE detainer, and within 24 hours actually carries out a murder.”¹¹
Sean Kennedy, president of Virginians for Safe Communities, added, “Fairfax County leaders didn’t make a mistake, they abetted murder through gross negligence and malign hubris. The local Soros-backed prosecutor Steve Descano has a policy to reward criminal aliens by dropping or reducing charges to avoid immigration consequences while the county officials actively protect foreign criminals from ICE.”¹²
Governor-elect Abigail Spanberger is reportedly considering Sheriff Kincaid for a top Virginia State Police position, despite the fallout from this deadly incident.¹³
George Soros poured $601,369 into Descano’s 2019 campaign through his Justice and Public Safety PAC — 72% of the prosecutor’s total war chest.¹⁴ Descano openly admits that his office avoids prosecuting cases that could have “immigration consequences” for defendants.¹⁵
Under President Trump, ICE arrests in Virginia nearly tripled compared to the previous administration.¹⁶ Yet sanctuary jurisdictions like Fairfax remain weak points in enforcing the law.
The question is now whether Virginia voters will continue tolerating officials who protect MS-13 gang members at the expense of American families. This isn’t merely about immigration policy; it’s about prosecutors funded by George Soros deliberately undermining public safety — and an innocent man in Reston has already paid the ultimate price.
