Judge Scott McAfee’s initial ruling had allowed Willis to stay on the case as long as her special prosecutor, Nathan Wade, stepped down. However, the appeals court found that this remedy did not sufficiently address concerns about impartiality.
“The remedy crafted by the trial court to prevent an ongoing appearance of impropriety did nothing to address the appearance of impropriety that existed at times when DA Willis was exercising her broad pretrial discretion about who to prosecute and what charges to bring,” the ruling further explained.
The controversy surrounding Willis deepened with revelations about her relationship with Wade. Reports revealed that Willis and Wade had an affair before she hired him as part of the investigation into Trump. During the lengthy probe, Wade allegedly accrued nearly $700,000 in legal fees, some of which were purportedly used to fund vacations for the couple.
These developments have raised questions about the ethical standards of the investigation and further fueled claims that the case was politically motivated.
Former President Trump hailed the decision, calling it a vindication of his long-standing claims that the case was a partisan attack orchestrated by the Biden administration.
“It was started by the Biden DOJ as an attack on his political opponent, Donald Trump,” Trump said in an interview with Fox News. “They used anyone and anybody, and she has been disqualified, and her boyfriend has been disqualified, and they stole funds and went on trips.”
Trump also called for the case to be dismissed entirely, arguing that the court’s ruling exposed its corrupt foundation. “There is no way such corrupt people can lead a case, and then it gets taken over by somebody else,” he stated. “It was a corrupt case, so how could it be taken over by someone else?”
The state of Georgia will now have to appoint a new prosecutor to handle the case. However, this process could delay proceedings significantly, and there is speculation that the case might ultimately be dropped. Trump urged Georgia officials to use this opportunity to end what he described as a “sham” investigation.
“There is no way such a corrupt and incompetent case should move forward,” Trump told Fox News Digital. “The case has to be thrown out because it was started corruptly by an incompetent prosecutor who received millions of dollars through her boyfriend – who received it from her – and then they went on cruises all the time.”
In addition to dismissing the case, Trump believes that an apology is owed to himself and the 18 individuals who were indicted alongside him, including his supporters, aides, and attorneys.

“Everybody should receive an apology, including those wonderful patriots who have been caught up in this for years,” Trump concluded.
