In a significant development, Fulton County Superior Court Judge Scott McAfee dropped two criminal charges against former President Donald Trump on Thursday. The dismissed charges are part of the larger RICO case initiated by District Attorney Fani Willis. This legal battle stems from allegations tied to Trump’s challenge of the 2020 election results, a move that Willis and her team have pursued aggressively since the controversial indictment in August 2023.
The dropped charges specifically pertain to conspiracy and the filing of false documents. Judge McAfee clarified that these accusations fall outside of the jurisdiction of Willis, who, as a local district attorney, lacks the authority to prosecute them at a federal level. This ruling marks a notable victory for Trump and his legal team, as five of the 13 charges initially brought against him have now been dismissed. “President Trump and his legal team in Georgia have prevailed once again,” read a statement from Trump’s lawyers following the ruling.

Judge McAfee’s recent decision is not the first time he has quashed charges in this case. Earlier this year, in March, he dismissed three additional counts from the indictment. At that time, McAfee’s order stated that the charges were inadequately substantiated, with specific focus on allegations involving Trump’s solicitation of elected officials to violate their oaths of office. These charges, tied to the infamous January 2, 2021, phone call between Trump and Georgia Secretary of State Brad Raffensperger, have been at the heart of Willis’s case. Critics argue that this phone call, in which Trump reportedly pressed Raffensperger to “find” enough votes to overturn Georgia’s election results, was not as sinister as the prosecution suggests.
