Trump, however, saw the decision very differently.
“Republicans just got another bad decision from the United States Supreme Court, one that the Court System took forever to give, and then blamed it, in part, on no time left to implement a solution to our totally CORRUPT and out of control Mail-In voting ‘disaster,’ which is a laughing stock all over the World, and where we are the only country that has to endure such a Nation Destroying SCAM,” Trump wrote.
He then turned his attention directly toward the justices.
“The Court’s inability and unwillingness to do the right thing for our Country will go down, in a very negative way, in the annals of History.”
Trump specifically praised Alito and Thomas, the two justices who dissented from the Court’s decision.
“Justices Alito and Thomas, legends both, strongly disagreed with this horrible, highly political, ruling,” Trump wrote.
The president’s frustration goes beyond the mail-ballot case. In the same statement, he criticized the Supreme Court over several other decisions, including cases involving presidential tariffs and birthright citizenship.
“The Supreme Court has really let our Country down! Certain Justices are petrified of these crazed and depraved Democrats, and are totally unable to show the courage necessary to save our America,” Trump said.
He also argued that previous decisions by the Court could carry enormous financial and political consequences for the country.
Trump’s comments underscore a growing break between the president and several members of the Court who were appointed by Republican presidents. The current dispute is particularly notable because three of Trump’s own nominees—Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett—did not join Alito and Thomas in dissenting from the mail-ballot ruling.
Trump was especially critical of those justices.
“These are not the people I interviewed to serve on the United States Supreme Court, they are merely a shell of their original selves, a Court that is costing the United States Trillions of Dollars with shockingly bad rulings that are of such magnitude that it won’t be easily possible for our Country to recover or heal.”
The president went even further, accusing the Court of allowing political pressure to influence its decisions.
“This Supreme Court is bullied and cajoled by the Radical Left into making decisions that have set America back at least a hundred years,” he continued.
Those statements came after the Supreme Court’s unsigned order concluded that the administration was unlikely to prevail on the merits of its challenge and that the circumstances did not justify emergency relief.
Alito’s dissent offered a dramatically different legal assessment. Writing for himself and Thomas, Alito argued that the government had met the requirements for a stay and criticized the majority for refusing to allow the rules to proceed. He also argued that the challengers’ legal theory faced significant problems.
The administration’s case had moved rapidly through the courts in the weeks leading up to the midterms. The Justice Department asked the Supreme Court to intervene after lower courts blocked enforcement of the Postal Service requirements. The Supreme Court’s decision leaves those lower-court restrictions in place for the 2026 election.
For Trump, however, the ruling represents more than another legal setback. He framed it as part of a broader struggle over election administration, federal authority and the future of mail-in voting in America.
“Likewise, the Supreme Court’s Decision on Birthright Citizenship is a complete and total disaster for America, and has already led to massive corruption with respect to ‘citizenship’ in our Country.”
He continued:
“The damage done to America is incalculable, and they know this, just as everyone else does – It is an irreparable and unrecoverable harm!”
Trump concluded by acknowledging that publicly attacking the nation’s highest court could carry consequences for him politically and institutionally.
“It is not easy for me to write this criticism of the United States Supreme Court – it will likely cost me dearly for years to come – but I feel it my obligation and duty, as President, to do so for the America we love!”
The administration has indicated that it will comply with the Supreme Court’s decision. Meanwhile, the ruling means states will continue operating under their existing mail-voting procedures for the 2026 midterms rather than adopting the administration’s proposed federal requirements this late in the election cycle.
Trump’s extraordinary rebuke now puts the Supreme Court—and particularly the justices he once selected for the bench—directly in the spotlight as the country heads toward another consequential election.
