Trump 1, Newsom 0: Tariff Suit Dismissed!

In yet another legal blow to California’s leadership, a federal judge has dismissed Governor Gavin Newsom and Attorney General Rob Bonta’s lawsuit targeting former President Donald Trump’s economic tariffs. Judge Jacqueline Scott Corley, a Biden appointee sitting in San Francisco, tossed the case Monday on jurisdictional grounds — effectively putting the brakes on the Democrats’ latest legal crusade.

Newsom and Bonta launched the lawsuit back in April, aiming to challenge Trump’s tariffs under the International Emergency Economic Powers Act (IEEPA). But Corley didn’t buy their approach. Instead of granting their request to keep the case in the U.S. District Court for Northern California or transfer it to the U.S. Court of International Trade in New York — a venue Trump’s legal team suggested — she opted to dismiss it altogether.

But this isn’t the end of the road. Bonta and Newsom plan to race the case straight to the famously liberal 9th Circuit Court of Appeals.

“Today, our lawsuit challenging the Trump Administration’s disastrous and illegal tariffs was allowed to remain in California pending our incoming appeal,” Bonta claimed. “We strongly believe this case belongs in federal district court and are pleased the court considered our wishes in dismissing this case so we have the opportunity to seek review.”
