“I am ready to do everything in my power to ensure our state and nation do not go backwards,” James stated. “Together with Governor Hochul, our partners in state and local government, and my colleague attorneys general from throughout the nation, we will work each and every day to defend Americans, no matter what this new administration throws at us. We are ready to fight back again.”
Fox News host Harris Faulkner questioned Gowdy on James’ determination to escalate legal challenges against Trump. She asked, “What do you make of the fact that her first reaction to Trump’s landslide re-election was to promise more lawfare?”
Gowdy didn’t mince words. He welcomed James’ approach, emphasizing that this very tactic is what pushed Americans to reject Democrat control in the first place.
“Keep talking, keep doing it. That’s exactly why you got hammered,” Gowdy remarked. “Keep using our justice system as a political weapon, and who knows – they may amend the Constitution and let him serve a third term. We may get a supermajority in the House and the Senate if these coastal elite liberals continue their thought process when it comes to our justice system.”
The U.S. Constitution’s 22nd Amendment limits presidents to two terms. However, Gowdy pointed out that if Republicans gain a two-thirds majority in Congress and enough control at the state level, they could propose a constitutional amendment to allow Trump to run again in 2028.
For such an amendment to pass, it would need approval from three-fourths of state legislatures or a Constitutional convention – depending on how Congress frames the proposal. Gowdy suggested that Democrats’ relentless legal pursuits could push Republicans to secure the necessary majorities.
“If these tactics continue,” Gowdy asserted, “the GOP could achieve those magic numbers.”

As Democrats like Letitia James persist in their legal battles against Trump, they risk alienating more voters who view these actions as partisan overreach. The backlash has already handed Republicans sweeping victories, and as Gowdy warns, it could pave the way for an unprecedented amendment to the Constitution.
The message from voters is clear: weaponizing the justice system has consequences. Whether Democrats heed this warning or continue down their current path remains to be seen – but the stakes couldn’t be higher.
