Rep. Eric Swalwell is now scrambling to contain a political storm that could not have come at a worse time, as new reports suggest the FBI may release documents tied to his past connection with a suspected Chinese operative. With California’s gubernatorial race heating up, the controversy is quickly turning into a high-stakes showdown involving federal law enforcement, election timing, and questions about transparency.
Swalwell’s legal team is pushing back aggressively. In a sharply worded letter sent to FBI Director Kash Patel, his attorneys accused the bureau of engaging in what they describe as a politically motivated smear campaign. The letter, reportedly obtained by the Associated Press, signals that Swalwell is prepared to escalate the fight into the courts if necessary.
“[Y]our attempt to release the file is a transparent attempt to smear him and undermine his campaign for Governor of California,” Swalwell’s attorneys, Sean Hecker and Norm Eisen, said in a recent letter to Patel obtained by The Associated Press. “Your actions threaten to expose you, others at the FBI, and the FBI itself to significant legal liability. Indeed, disclosure of the investigative file would violate federal law in several respects.”
The confrontation comes after reporting from The Washington Post revealed that Patel is considering whether to make public records tied to Swalwell’s past interactions with Christine “Fang Fang” Fang. U.S. authorities have long suspected Fang of operating as part of a Chinese intelligence effort aimed at cultivating political relationships within California.
