The legal team representing former President Donald Trump is sure that the Colorado Supreme Court’s decision to exclude him on the ballot in 2024 will be overturned by the highest court in the US.
“I find it ironic that there’s a January 6 charge pending, but due process doesn’t matter because Colorado’s liberal judges want to take him off the ballot because they can’t beat Biden in the ballots,” Lawyer Alina Habba stated on SiriusXM’s “Breitbart News Daily” that it is “not a constitutional decision” and “it will be overturned by the Supreme Court.”

Despite their being no criminal accusations or convictions, a Colorado court uses the 14th Amendment’s “insurrection” restriction to remove Trump. Conclusion: 4–3.
The ruling will not be made until January 4th, when an appeal will be taken into consideration. According to CNN, the country anticipates that the US Supreme Court will hear the issue and render a verdict before then.
Despite solely affecting Colorado, the historic ruling will have a significant impact on the 2024 presidential contest. Election officials in Colorado have said that a resolution must be completed by January 5, which is the legal deadline for selecting the Republican primary candidates.
Rejected: The 14th Amendment, which, despite its ambiguous language and exclusion of references to the presidency, forbade “engaged in insurrection” anyone from holding public office in more than two cases since 1919.
Democratic administrations nominate seven judges to Colorado’s highest court. The statewide retention elections were won by six of these justices, securing their places; the seventh judge, who was appointed in 2021, is still awaiting a vote.
Habba stated that there is “no question in my mind” that the Colorado decision will be overturned by the US Supreme Court in her Breitbart interview.
She continued by saying that, in her opinion, this is just another instance of judges trying to establish themselves while seeing themselves as “pioneers for the liberal radical left.”
“You’re not a pioneer. You’re going to look ridiculous. You do not understand due process. You do not understand the Constitution. You are a state-level court that is going to look ridiculous, okay? When the Supreme Court—whether you’re a federal judge or a state judge—overturns you, that’s not a good look,” Habba said.

“And there is no question in my mind. Due process exists for a reason. There has to be some America left,” She went on to say that she thought the decision was completely “ridiculous.”
“I’m not even concerned that the Supreme Court will make the right decision here,” Habba went on to remark that each and every left-wing court ruling and lawsuit “flies in the face of any kind of rational, legal mind.”
“It’s ridiculous, and it’s so desperate. It’s just so desperate,” She went on to explain that any decision that appears to be politically motivated against Trump just serves to alienate supporters, particularly Independents who believe he is being punished politically.
“We don’t even have the option in Colorado to vote for who we want. The leading candidate, we don’t even have the option because they’re so afraid,” she said, blasting the “anti-American, self-interested behavior that they will go as far as to take away your option to vote for President Trump.”
“That is so sad and pathetic, frankly. I mean, it’s just ridiculous. I have no words. I’m rarely speechless, as you know. But I am speechless,” Habba continued, refuting Democrats’ claims that the ruling is about “protecting democracy.”
Instead, it is “about stealing 2024 because they can’t win,” she said.
“So they already did the Russia hoax. They got caught on that. So now we have to do something different. That’s what this is. The radical left is desperate, and it’s obvious and pathetic,” she added.
