According to Common Cause, the hypothesis “implicates fundamental questions of self-governance and our constitutional structure” and that the idea of the Independent State Legislature “has contributed to growing public doubt about the lawfulness and integrity of federal elections.”
According to proponents of the independent legislative thesis, the elections provision of the Constitution must be strictly interpreted: “The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof.”
