De la Vega’s history in politics stretches back over a decade. He became politically active in 2010 advocating for the DREAM Act. Despite his immigration status, he secured government roles, including work with former Assemblymember Robert J. Rodriguez and Rep. Carolyn Maloney (D-NY). His past was never a secret—and now, it’s becoming a legal liability.

In a past interview with Migrant Insider, AOC praised de la Vega, stating, “Diego is amazing.” But now, his involvement could land her in hot water.

By March of this year, de la Vega voluntarily left the country amid increasing scrutiny and growing deportation fears. According to TownHall.com, his departure coincided with intensified efforts by the Trump administration to crack down on unlawful employment and illegal border crossings.

The plot thickens further. AOC is also being investigated for her involvement in seminars that allegedly provided undocumented immigrants with strategies to sidestep ICE enforcement. According to Homan, her actions could constitute interference in federal law enforcement operations.

Earlier this year, Ocasio-Cortez hosted a controversial “Know Your Rights” webinar. The forum, conducted in both English and Spanish, instructed illegal immigrants on how to avoid deportation. Attendees were told they didn’t have to open the door to ICE unless agents had a judge-signed warrant. Her office even distributed privacy release forms—documents that allow congressional offices to involve themselves in deportation cases.

It didn’t stop there. AOC’s team also offered guidance on finding free legal aid. Critics argue this crossed a line from advocacy into obstruction.

In February, Homan formally requested that the Deputy Attorney General open an investigation. Since then, AOC says she’s been stonewalled.

“I’ve asked them, they haven’t responded to me,” Ocasio-Cortez told Fox News. “But you know, I was once again fully using the First Amendment to inform people of their constitutional rights. They say a lot of things, but I’ve written a formal letter, and they won’t respond.”

The New York Democrat has framed the investigation as a political attack designed to punish her activism. In a dramatic statement, she warned that detaining an elected official without grounds would mark a “tremendous sea change and escalation in what this administration is willing to do to bend laws, norms, et cetera, and how a normal functioning democracy works.”

“I sure hope that for all the saber-rattling that this administration is doing, that they really think about the global consequences of what it means for the United States,” she added.

AOC’s defenders claim this is a witch hunt meant to chill dissent. But critics argue that she crossed the line from lawmaker to lawbreaker.

What started as a quiet email from Tom Homan to the DOJ has now exploded into a full-blown investigation with national implications. With illegal hiring, interference in ICE operations, and a deeply controversial immigration agenda all under scrutiny, one thing is certain—this story isn’t going away any time soon.

And if the accusations prove true, the fallout could reshape how Congress handles national security, immigration enforcement, and constitutional accountability.
