Trump and others are restrained by Judge Tanya Chutkan from criticizing Special Counsel Jack Smith and his staff. No disparaging remarks about court personnel are permitted either.
Some of the limits asked by prosecutor Smith, who is presently in charge of the federal prosecution against Trump for allegedly attempting to rescind the results of the 2020 election, have been granted by Judge Chutkan’s decision.
Before issuing her decision at the conclusion of the hearing, Judge Chutkan raised reservations about the size of Smith’s proposed order.

The case’s district judge, Amy Berman Jackson, posed an intriguing query to the prosecutor, Molly Gaston. Judge Jackson asked Gaston to define precisely which claims made by the former president Trump would be deemed “disparaging” and so banned by the gag order. She also questioned if it would be feasible to carry out such an order against a former president.
Chutkan and Trump’s defense attorney John Lauro argue over restricting the client’s remarks made outside of court and the First Amendment rights that were violated.
According to Lauro, a gag order would be detrimental to Trump’s 2024 presidential candidacy. He claims that Trump is being silenced by President Biden’s Justice Department and implies—without offering any proof—that the case against him has something to do with his attempt to unseat Biden from the White House.
