“President Trump is right when he said the immunity decision would help President Obama,” Schoen said during an appearance on Newsmax. “But you know what it doesn’t help him with? Impeachment.”

Schoen cited Article I, Section 3, Clause 7 of the U.S. Constitution—the very same clause Democrats invoked to justify the second impeachment trial of President Trump. That section says an impeached official, even if already out of office, can still be barred from holding public office again and may face criminal charges.

“According to the Democratic Party and the House managers in the second impeachment trial, a former President, once out of office, is still subject to impeachment,” Schoen explained.

He went even further, saying that by their own logic, even historical figures like Abraham Lincoln or George Washington could be impeached posthumously. But in the real world, the focus is now zeroing in on Obama. Schoen made it clear that if the evidence against the former president holds up, Democrats might have walked straight into a trap of their own making.

“In other words, they’ve argued Lincoln could be impeached, George Washington impeached. Certainly, as I predicted at the time, this would come back — they would rue the day — because President Obama could be impeached if this evidence really says what it says. And that could also strip off the immunity, because under Article I, Section 3, Clause 7 of the Constitution, the Democrats argued it bars one from holding further office. The language itself says you’re still subject to criminal prosecution or indictment. We’ll see how that plays out.”

And Schoen isn’t the only one raising red flags. Mike Davis, a constitutional expert and founder of the Article III Project, echoed the sentiment in a separate interview with Benny Johnson. According to Davis, Obama enjoys no legal protection for crimes committed after leaving office.

Davis explained that immunity is strictly limited to official acts performed during a president’s time in office. The moment they leave, that shield disappears. That means any illegal acts—especially a potential cover-up after leaving the White House—could absolutely result in criminal charges.

This legal bombshell comes as newly unsealed documents are beginning to surface—declassified files reportedly released under the authority of Director of National Intelligence Tulsi Gabbard. According to these files, Obama may have had a direct hand in engineering the Russia collusion narrative—what many now believe was a politically motivated attack on President Trump from the start.

If these documents prove what they claim, the implications are staggering. Not only does it confirm that the entire Russia hoax was a partisan trap—it also places Obama at the center of it, opening the door to criminal exposure and constitutional consequences.

The tables may finally be turning. Democrats opened this Pandora’s Box. Now, their most prized political icon may be the one facing the fallout.
