New York Shielded Him. He Stabbed a Cop 7 Times.

Federal immigration officials say both men entered the United States unlawfully in 2023, were encountered by Border Patrol in Arizona, and were subsequently released into the country.

The attack has intensified an ongoing dispute between federal immigration authorities and New York officials over the handling of individuals facing criminal charges who are also subject to immigration enforcement.

DHS Reports More Than 16,000 Immigration Detainers Rejected

According to figures attributed to the Department of Homeland Security, New York authorities declined to honor 16,070 immigration detainers between January 20, 2025, and October 8, 2026.

Federal officials say the individuals associated with those requests had accumulated more than 52,000 criminal charges and convictions collectively.

The reported offenses include serious crimes such as homicide, sexual assault, kidnapping, armed robbery, and weapons violations.

An ICE detainer is a request asking a law enforcement agency to notify immigration authorities before releasing an individual and, where legally permitted, temporarily maintain custody to facilitate a transfer.

However, a detainer is not itself a criminal conviction, and the reported figures do not establish that every individual involved was convicted of a violent offense.

DHS Secretary Markwayne Mullin criticized sanctuary jurisdictions in a statement addressing the controversy.

“While sanctuary politicians continue to release dangerous criminals onto their streets, our brave law enforcement officers will continue to risk their lives to arrest these heinous criminals and make America safe again,” Mullin said.

The Mercedes case has become a prominent example in the administration’s argument that restrictions on cooperation with ICE can have consequences for public safety.

One Suspect Had Previously Drawn ICE Attention

Federal officials identified Mejia Bautista as an individual who had already come to the attention of immigration enforcement authorities.

According to the account provided by DHS, ICE issued a detainer following a weapons-related charge in October 2025.

Nevertheless, Mejia Bautista was subsequently released from custody.

Authorities also described an extensive arrest history involving Caraballo.

He reportedly had five previous encounters with the NYPD involving allegations that included reckless endangerment, illegal firearm possession, drug possession, and possession of burglary tools.

DHS contends that Caraballo repeatedly left custody before federal officers could submit immigration detainer requests.

Those circumstances have raised questions about whether better coordination between local police departments and federal immigration authorities could have prevented additional encounters with law enforcement.

The suspects’ earlier arrests do not establish guilt in the stabbing case, and the precise legal circumstances surrounding their previous releases remain important to evaluating the federal government’s claims.

Mamdani Administration Faces Questions Over Sanctuary Rules

New York City’s immigration policies have also attracted attention from congressional Republicans.

Mayor Zohran Mamdani signed an executive order reinforcing protections associated with the city’s sanctuary framework, according to the account of the controversy.

Those policies generally restrict the circumstances under which municipal agencies cooperate with federal civil immigration enforcement.

In May 2026, the House Judiciary Committee initiated an investigation involving Mamdani and six additional city officials.

The committee reportedly found that New York City complied with fewer than 4% of ICE detainer requests during the period spanning 2022 through the middle of 2025.

Republican lawmakers argue that the low compliance rate illustrates a serious breakdown in cooperation between federal and local authorities.

City officials and supporters of sanctuary policies have generally defended such restrictions as a way to preserve trust between immigrant communities and local police while observing legal limits on detention.

The dispute centers on whether those restrictions create avoidable public safety risks or appropriately separate local policing from federal immigration responsibilities.

Hochul and Federal Officials Clash Over Immigration Enforcement

New York Governor Kathy Hochul has also faced criticism from Republicans who contend that state policies interfere with federal efforts to remove individuals accused or convicted of serious crimes.

During a congressional hearing, Rep. Elise Stefanik cited violent incidents involving immigrant suspects while challenging Hochul’s approach to immigration enforcement.

Stefanik delivered a pointed assessment of the governor’s record.

“She created this crisis.”

Hochul, meanwhile, resisted the prospect of a broader federal immigration enforcement deployment across New York.

Responding to the possibility of additional ICE personnel entering the state, the governor said:

“Donald Trump himself said he would not send a surge of ICE agents to the state of New York unless I ask. I’m not asking.”

The disagreement reflects a larger conflict over the responsibilities of state governments and federal immigration authorities.

Republicans maintain that refusing certain detainers can result in individuals being released before ICE has an opportunity to take custody.

Supporters of the restrictions argue that immigration enforcement should remain primarily a federal responsibility and that local detention decisions must comply with applicable laws.

ICE Warns That Street Arrests Carry Additional Risks

Federal officials have also argued that limitations on jail-based transfers force immigration agents to conduct more arrests in public settings.

Such operations can involve additional uncertainties because officers may encounter suspects in residential buildings, busy neighborhoods, or other uncontrolled environments.

On October 8, an ICE officer shot an individual described by DHS as an undocumented immigrant with a criminal history during an enforcement operation in Marble Hill.

The department attributed the circumstances surrounding that confrontation to New York’s restrictions on immigration cooperation.

Mullin addressed the broader dispute with another warning.

“When you have sanctuary cities and sanctuary politicians, you endanger the safety of the public.”

Federal officials argue that arranging transfers while individuals remain in custody can reduce the need for potentially dangerous operations elsewhere.

However, determining whether a particular arrest or violent incident could have been prevented requires examining the relevant detention history, legal restrictions, and decisions made by authorities.

Detective’s Injuries Put Renewed Focus on Public Safety

The reported attack on Detective Mercedes has brought a deeply personal dimension to a dispute often dominated by statistics, executive orders, and congressional hearings.

A police detective suffered seven stab wounds while confronting two alleged attackers, according to the account of the incident.

The suspects’ reported immigration histories and previous encounters with law enforcement have prompted renewed scrutiny of how criminal justice agencies communicate with federal immigration officials.

For Republicans pressing New York to expand cooperation with ICE, the case offers another reason to demand changes to detention and notification procedures.

For state and city officials defending the existing framework, the controversy raises questions about how to address violent offenders while maintaining legal protections and local policing priorities.

Ultimately, the central issue extends beyond one investigation.

It concerns whether New York’s current system provides sufficient coordination among police, correctional agencies, prosecutors, and federal immigration authorities when individuals accused of serious offenses are released from custody.

As the criminal proceedings involving Mejia Bautista and Caraballo move forward, the circumstances surrounding their earlier arrests and releases are likely to remain a significant focus of the debate.

For Detective Mercedes, the consequences of the Bronx confrontation are far more immediate than the political argument unfolding around it.
