Gianforte stated that he signed the law to “protect Montanas’ person, private, and sensitive data” from being gathered by the Chinese government in a news statement that was made public by his office.
“The Chinese Communist Party using TikTok to spy on Americans, violate their privacy, and collect their personal, private, and sensitive information is well-documented,” Gianforte stated. “Today, Montana takes the most decisive action of any state to protect Montanans’ private data and sensitive personal information from being harvested by the Chinese Communist Party.”
TikTok usage on government-owned equipment is already forbidden by the federal government and state organizations in Montana. SB 419 expands the prohibition to include personal devices, going one step further. According to the document, “Tiktok may not operate within the territorial jurisdiction of Montana.” Additionally, the law forbids application providers like Apple and Google from enabling TikTok downloads on their systems.
Prepare, TikTok! The Montana Department of Justice will soon have the authority to impose fines on app shops or ByteDance of up to $10,000 for each transgression and an extra $10,000 daily for persistent offenses. Don’t tamper with the new legislation in Montana!

SB 419 is approved by the Montana House with a vote of 54-43, after the Montana Senate approved it on March 2 with a vote of 30-20.
