Acting U.S. Attorney for New Jersey Alina Habba confirmed the charges, saying her office is holding McIver accountable for her brazen attack on law enforcement.
“Today my office has charged Congresswoman McIver with violation of Title 18, United States Code, Section 111(a)(1) for assaulting, impeding and interfering with law enforcement,” Habba wrote on X.
In her formal statement, Habba explained the decision wasn’t made lightly.
“I have persistently made efforts to address these issues without bringing criminal charges and have given Representative McIver every opportunity to come to a resolution, but she has unfortunately declined,” she stated. “No one is above the law — politicians or otherwise.”
The hypocrisy is staggering. Democrats spent years demanding harsh sentences for peaceful January 6th protesters, insisting that “no one is above the law.” But now that one of their own is on the wrong side of justice, suddenly it’s a “political attack.”
McIver tried to defend her outrageous behavior by shifting blame to ICE agents — the very people she’s accused of assaulting.
“Earlier this month, I joined my colleagues to inspect the treatment of ICE detainees at Delaney Hall in my district,” McIver said. “We were fulfilling our lawful oversight responsibilities… Instead, ICE agents created an unnecessary and unsafe confrontation when they chose to arrest Mayor Baraka.”
That’s right — according to McIver, the real villains weren’t the trespassing lawmakers who ignored protocol and instigated a mob scene inside a federal facility — it was the officers trying to maintain law and order.
But Habba made it clear that this wasn’t about oversight — it was about accountability.
“Congressional oversight is an important constitutional function, and one that I fully support,” she said. “However, that is not at issue in this case.”
The incident comes amid rising tensions over President Donald Trump’s plans to restore immigration enforcement if re-elected. Democrats, desperate to score political points and protect sanctuary policies, appear willing to go to extremes — even if it means attacking the very law enforcement agencies tasked with protecting our borders.
McIver and her cohorts claimed they were conducting oversight, but didn’t even bother to follow the standard process of scheduling a visit. Instead, they barged in, broke federal protocol, and erupted into what officials are calling a full-scale riot.
Footage doesn’t lie — and in this case, it shows a sitting member of Congress acting more like a violent protester than a public servant.
The Department of Homeland Security has confirmed that further arrests could follow as the investigation continues.
One thing is clear: Democrats love to preach about law and order — until it applies to them. Now, with federal charges on the table, McIver is learning the hard way that political privilege doesn’t shield you from the law.
No matter how many times Democrats chant about “democracy,” their actions are exposing what they really stand for: chaos, double standards, and open defiance of the very system they claim to defend.
The rule of law still matters in this country — and it just caught up with Rep. LaMonica McIver.
