In a politically charged move that’s already sending shockwaves through the legal and political arenas, Democrat Mayor of Newark, Ras Baraka, has launched a lawsuit against Interim U.S. Attorney Alina Habba, accusing her of “false arrest and malicious prosecution.” The suit also targets Ricky Patel, a top Homeland Security official in Newark, alleging a gross abuse of power that violated Baraka’s constitutional rights.
According to the explosive 17-page complaint filed by Baraka’s legal team, Habba—a known ally of former President Donald Trump—acted as a “political operative,” using her prosecutorial power not for justice, but for partisan gain.
The lawsuit claims that Habba trampled on Baraka’s rights under the First, Fourth, and Fifth Amendments of the Constitution, framing his arrest and brief prosecution as a politically motivated stunt rather than a legitimate legal action.
The situation escalated dramatically last month when Mayor Baraka was arrested after entering the Delaney Hall ICE detention facility without authorization. The charge? Misdemeanor criminal trespass. But just as quickly as the arrest made headlines, the case was quietly dismissed less than a week later by Habba’s office.
