Levin’s criticism stemmed from a recent ruling where Roberts and Barrett joined the Supreme Court’s liberal justices in rejecting Trump’s appeal for a stay of proceedings. The case in question centers on allegations of falsifying business records—charges brought forth by Judge Juan Merchan, a known donor to President Joe Biden. According to Levin, this decision effectively greenlights a miscarriage of justice.

“A jury returned an illegitimate guilty verdict on fake crimes based on unconstitutional jury instructions offered by Merchan,” Levin said, pointing to what he sees as a fundamentally flawed legal process. Merchan allegedly allowed jurors to convict Trump on arbitrary secondary crimes, a move that Levin argued undermines the bedrock principle of unanimous verdicts in criminal cases.
