A bill introduced by Louisiana Republican Congressman Clay Higgins seeks to prohibit states from eliminating a candidate affiliated with a major political party from their ballot.
“New law… If any state in our Union blocks the official nominee of a major political party from the Presidential ballot, their electoral slate will not be counted by Congress on the following January 6th,” Higgins announced the bill in an X post.

Introducing a revolutionary bill designed to improve the electoral process’s integrity: the “Presidential Ballot Integrity Act”. The purpose of this proposed legislation is to add a crucial clause from the Electoral Count Act of 1887 to title 3, United States Code. If this clause is approved, it will mean that a state’s electorate’s vote will not be tallied if the nominee for president of a major political party is not listed on the state’s ballot. This bill seeks to address potential flaws in the electoral system and advance a stronger democracy, with a clear focus on maintaining justice and accountability.
Title 3 of the United States Code, Section 15(e)(1)(B), is to be changed by the proposed legislation. It proposes to insert the following amendment after “shall not be counted”: “if, in the specific State of the elector under consideration, a nominee for President from a significant political party was not included on the state ballot.”
In direct response to the Colorado Supreme Court’s ruling to remove former President Donald Trump from the state’s primary ballot, Higgins introduced a bill. The 14th Amendment’s Section 3, which forbids former US officials who took part in a “insurrection” from running for office, served as the foundation for this decision.
