New York’s ambitious attempt to force fossil fuel companies to bankroll tens of billions of dollars in climate-related spending has suffered a major defeat in federal court.
A federal judge ruled Monday that the state cannot enforce its Climate Change Superfund Act, handing a significant victory to the coalition of states and industry organizations that challenged the controversial program.
The law, formally known as the Climate Change Adaptation Cost Recovery Program, was designed to extract billions from major fossil fuel producers based on greenhouse gas emissions attributed to their products between 2000 and 2018.
