A significant misstep by U.S. District Judge Tanya Chutkan could have a critical impact on the federal election interference case against former President Donald Trump, according to former federal prosecutor Andrew McCarthy. Chutkan’s decision to allow the public release of over 1,800 pages of evidence tied to special prosecutor Jack Smith’s investigation has sparked serious concerns, with McCarthy arguing that it risks tainting the potential jury pool before the trial even begins.
Last week, Chutkan ruled that additional documents connected to Smith’s probe should be made available to the public. However, McCarthy, speaking on Fox News’ “The Story” guest-hosted by Trace Gallagher, voiced his dismay. He emphasized that such a move in the context of a highly politicized case could undermine the fairness of Trump’s trial. “I’m not curious because I thought from the beginning this was a political exercise,” McCarthy remarked, suggesting that the timing and strategy behind the release of these documents were politically motivated.

According to McCarthy, in a “normal” case, a judge would be primarily concerned with ensuring that the jury remains impartial. He expressed disbelief at Judge Chutkan’s decision to downplay this responsibility, stating, “Contrary to what Judge Chutkan says, her responsibility is not to the American people writ large to fill the campaign airwaves with new information. Her responsibility is to give Trump a fair trial and make sure the jury pool’s not prejudiced.”
