U.S. Magistrate Judge Barbara Holmes is facing a storm of criticism after she allowed the release of Kilmar Abrego Garcia, a Salvadoran illegal alien charged with human trafficking. Her ruling, handed down on Friday, has sparked outrage as Garcia walked free instead of being kept in custody ahead of trial.
Garcia, who authorities suspect is tied to the violent MS-13 gang, was released from federal custody on Tuesday. This decision came after Judge Holmes dismissed the government’s request to detain him, despite the serious charges against him.
The Salvadoran national was first stopped in Tennessee back in 2022. He was driving a vehicle flagged by the Department of Homeland Security, which was registered to a convicted human trafficker. Inside the car, officers discovered multiple illegal aliens from South and Central America.
Garcia, who resides in Maryland, claimed he was simply transporting the passengers from Houston, Texas to Maryland for work opportunities. Federal investigators, however, allege the trip was part of a larger human smuggling operation.
