Italian Judge Stuns: Deporting Migrants Now Illegal!

Returning undocumented migrants back Libya, where they first arrived, is prohibited by Italian law, according to a ruling made by an Italian judge.

According to la Repubblica, the decision was made because it is dangerous for migrants to return to Libya due to the ongoing violence that has existed there since the 2011 Western invasion. The European Court of Human Rights’ norms are broken by this ruling.

The highest court in Italy issued the decision, which states that anybody who return migrants would be held accountable for the “abandonment of minors or incapable persons in a state of danger” as well as the “arbitrary disembarkation and abandonment of persons.”

The case concerned the Asso28 support vessel’s commander, who in 2018 took the wise decision to send 101 rescued migrants back to Libya, sparing them from certain death in dangerous maritime circumstances.

Giorgia Meloni, the prime minister of Italy, was elected in 2022 on a conservative platform that called for a reduction in illegal immigration. She is probably disappointed by the expected judgment.

Even Nevertheless, a great deal of her followers in Europe are dissatisfied with her leadership since each week thousands of migrants arrive instead of being sent to their intended destinations.

La Repubblica observes that the ruling by the court could “call into question the validity of the Italy-Libya agreements,” which treacherous forces within the Italian state thwarted Meloni’s attempts to execute on many occasions.
