DHS Under Scrutiny

Prosecutor Mark McCarren admitted that DHS had already deleted press releases tied to the case and promised to work on removing lingering social media posts. One particularly inflammatory post still live on the official DHS X account accused members of Congress of having “stormed” the ICE facility gates.

That alleged “storming” is at the heart of the controversy. Prosecutors claim McIver interfered with the arrest of Newark Mayor Ras Baraka, who was taken into custody for trespassing outside the same ICE facility. McIver was there with fellow Democrats Rob Menendez and Bonnie Watson Coleman on what she called an “oversight inspection.”

Caught on Camera

According to federal prosecutors, the so-called “oversight” turned physical when McIver “slammed” her forearm into an ICE agent and grabbed him in an effort to restrain him. They also claim she struck another officer while trying to re-enter a secure area of the facility. The government says the altercation was captured on surveillance and bodycam footage lasting just over a minute.

Her attorney, Paul Fishman, insists the congresswoman’s actions were part of her official duties protected by the Constitution’s Speech or Debate Clause.
Judge Semper pushed back, questioning how an alleged assault outside a facility gate could possibly qualify as “legislative business.”

“Part of a Broader Agenda”

McIver’s defense paints her as a political target. They accuse the government of retaliating against her for standing up to conservative immigration policies, describing the prosecution as “part of a broader partisan agenda of ending ‘wokeness.’”

President Trump himself has publicly commented on the situation, declaring, “the days of woke are over.” That statement has fueled the perception that McIver’s case is symbolic of a larger culture war playing out in courtrooms across America.

Fishman blasted the double standard, pointing to Trump’s past pardons for January 6 rioters.
“She was charged with something she never would’ve been charged with if she was a Republican,” he said.

The judge quickly noted that McIver’s Democratic colleagues present at the scene weren’t charged — a fact that undercuts the selective-prosecution claim.

“Stressful and Sleepless Nights”

McIver, however, insists she’s being unfairly punished for doing her job.
“Hearing prosecutors say I could get 17 years in jail for showing up to do my job, for protecting the people that I represent, who have elected me to protect them—it is stressful,” she wrote on X. “Some nights are sleepless, but we have to stand up for each other.”

The congresswoman’s trial is set for November 10, where prosecutors are expected to lean heavily on the bodycam footage to make their case. If convicted, she could face up to 17 years in federal prison — a stunning fall for a Democrat who built her career on fighting “abuses of power.”

Whether McIver walks free or becomes the next progressive martyr, her case is shaping up to be a political flashpoint — and a warning to lawmakers who think their “activism” places them above the law.
